Economic Espionage and National Security

The Economic Espionage and National Security program was presented by the United States District Court for the District of Minnesota, the Federal Bar Association - Minnesota Chapter, and the National Asian Pacific American Bar Association - Minnesota Chapter.

The program featured presentations and a panel discussion.

FBI Special Agent Shena Crow, with expertise in the areas of economic espionage and national security, spoke on (a) the current threats posed by state sponsored actors to acquire trade secrets and national security information in technologies of priority and interest; (b) techniques involving human intelligence and social engineering; and (c) best practices for protecting such information.

Brian A. Sun, partner of Jones Day, who represented Dr. Wen Ho Lee, described (a) his experience representing Dr. Lee in an investigation and case that lasted many years and ended with a United States district judge apologizing to the defendant and his family for the injustices that had occurred; and (b) lessons learned that can applied today. Additional perspective was provided by Judge Michael J. Davis, who sat on the Foreign Intelligence Surveillance Court from 1999-2006, when Dr. Lee's case came to light.

Peter R. Zeidenberg, partner of Arent Fox, who represented Dr. Xiaoxing Xi and Prof. Xiafen "Sherry" Chen. Mr. Zeidenberg, provided an overview of Dr. Xi and Professor Chen?s cases, which gave rise to the question of whether there was or is racial profiling and bias in these types of investigations and prosecutions.

Andrew M. Luger, partner of Jones Day and former United States Attorney for the District of Minnesota, provided introductory remarks. The organizing committee consisted of Judge Susan Richard Nelson, Magistrate Judge Tony N. Leung, Ivan K. Fong, 3M Senior Vice President Legal Affairs and General Counsel, and Mr. Luger.
